1. Acceptance of Terms

By accessing and using the services of ARK Home Improvement and Painting LLC (operating as SmartHomePath for smart home services), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Provided

We provide the following services in Central New Jersey:

• Interior and exterior painting
• Cabinet refinishing
• Deck and fence staining
• Drywall repair
• Power washing
• Color consultation
• Smart home installation and automation (under SmartHomePath)

3. Estimates and Quotes

Free estimates are provided to help you understand the scope and cost of your project. Estimates are:

• Valid for 30 days from the date of issuance
• Subject to change if project scope changes
• Not a binding contract until a formal agreement is signed
• Based on information provided at the time of assessment

4. Payment Terms

Unless otherwise agreed in writing:

• A deposit may be required before work begins
• Payment schedules will be outlined in your service agreement
• Final payment is due upon project completion
• We accept Cash, Cash App, Venmo, and Zelle
• Late payments may incur additional fees

5. Cancellation and Rescheduling

By Client:

• Cancellations must be made at least 48 hours before the scheduled start date
• Deposits may be non-refundable if materials have been purchased
• Rescheduling requests should be made as early as possible

By ARK:

• We reserve the right to reschedule due to weather, emergencies, or unforeseen circumstances
• We will provide reasonable notice and work to accommodate your schedule

6. Warranty and Guarantees

We stand behind our work with a 100% satisfaction guarantee:

• Workmanship warranty covers defects in our work for a specified period (detailed in your contract)
• Material warranties are provided by manufacturers
• We will address any issues promptly and professionally
• Warranty does not cover damage caused by improper use, accidents, or natural disasters

7. Client Responsibilities

To ensure quality service, clients agree to:

• Provide accurate information about the project and property
• Ensure access to work areas during scheduled times
• Remove or protect valuable items in work areas
• Provide utilities (water, electricity) as needed
• Notify us immediately of any concerns during the project
• Ensure pets are secured during service visits

8. Liability and Insurance

ARK Home Improvement and Painting LLC is fully licensed and insured:

• We carry general liability insurance to protect against accidents
• Workers' compensation insurance covers our employees
• We are not liable for pre-existing damage or defects not disclosed prior to work
• Claims must be reported within 30 days of project completion

9. Dispute Resolution

In the event of a dispute, we encourage open communication to resolve issues amicably. If a resolution cannot be reached, disputes will be settled through mediation or arbitration in accordance with New Jersey law.

10. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of modified terms.

11. Governing Law

These Terms of Service are governed by the laws of the State of New Jersey. Any legal action must be brought in the courts of New Jersey.
